About OutPink.com - Terms and Conditions
PARTNER agreement Terms & Guidelines
Partner participation in the outpink.com lifestyle, offers and discounts membership program is FREE.
This Partner Agreement (hereinafter this "Agreement") is made between Outpink Ltd (Trading as outpink.com), a Ltd Company, whose registered address is Studio 186, 77 Beak Street, Soho, London - W1F 9DB. - and the "Partner" as specified in the attached "Partner registration" document. outpink.com membership cards remain the property of Outpink Ltd.
- outpink.com is a business providing a lifestyle offers and discounts membership program (the outpink.com membership card) whereby outpink.com [subscribed members] may receive an offer or discount on goods and/or services provided by outpink.com Partners by producing a valid outpink.com membership card and/or promotional code [where applicable] upon payment or ordering of goods and/or services.
- outpink.com contracts with numerous Partners in providing the services described in this agreement and no single Partner has exclusivity.
- This agreement is between outpink.com and the Partner only for a period of 12 months - there are no third party beneficiaries to this agreement.
- outpink.com will at all times provide full details to the consumer of the outpink.com membership card on its website www.outpink.com with full Terms and Conditions Privacy Policy, in addition to details of the offers as per submitted by the outpink.com Partner - the Partner is obliged to check these conditions periodically.
The agreement between both parties is as per outlined below
This Agreement shall be construed and enforced in accordance with the laws of the United Kingdom.
Where can the outpink.com membership card be used
The outpink.com membership card is valid with any outpink.com Partner advertising/listed on the outpink.com website. - All Partners advertising their offer/discount on the outpink.com website are obliged to fulfil the offer as promoted.
Redeeming Partner offers/discounts
outpink.com members must present a valid outpink.com membership card - Proof of identity may also be requested by an outpink.com Partner.
- If purchasing on-line via one of our E-store Partners outpink.com members may be required to enter a promotional code [nominated by the Partner] - this promotional code is only viewable to outpink.com members who have logged on.
- outpink.com Partners reserve the right not to accept any outpink.com membership card which has become unreadable for any reason or which has been obtained by theft or fraud.
- All outpink.com Partner offers/discounts are subject to the Partner`s terms and conditions and availability. All Partner offers/discounts are non-redeemable for cash.
- outpink.com membership cards are valid for a period of 12 months - Please check the expiry date on the member`s card to verify it is still valid.
We reserve the right to
Remove the listing of any Partner`s who Outpink Ltd deems are advertisers and/or providers of any inappropriate services or fail to adhere to the outpink.com Partner agreement as outlined.
Benefits provided by outpink.com to Partners in this agreement
FREE listing on outpink.com:
Listed under (up to 4) search categories, selected by you - you provide up to 2 x images and your Business profile.
FREE outpink.com homepage feature:
Depending on the level of offer or discount provided, we may choose to feature your Business on our home page.
FREE inclusion:
In our monthly newsletter to outpink.com members advising of your Businesses offers or discounts. (One-off-upon joining)
FREE promotion/exposure:
With the outpink.com brand, targeting the 3 million plus Gays & Lesbians in the UK with combined earnings of more than £70 billion in 2005 - Source: "Out Now 2005 Diva and Gay Times Readers Surveys"
FREE extra Business:
Use outpink.com to increase your visibility and sales in non-peak times and peak-times - by enticing our members with an offer or discount.
At our own expense we will continue to grow the outpink.com brand via various media avenues - Incl, Web, regular advertising in participating Bars, Flyer campaigns, including during key Gay & Lesbian events, (i.e. Euro Pride), press advertising in leading UK Gay publications, and various other creative means.
Partner requirements
Offer or Discounts - YOU are required to provide outpink.com members with an offer or discount upon joining the outpink.com Partner program - which is valid for a 12-month period. The offer can be a "discount" or an "incentive" to attract outpink.com members to spend with your business. - Example offers: 15% of meals - 2 for 1 drinks - Free glass of wine/champagne with meals - 15% off purchases etc. You set the terms and conditions. - It`s your choice! **
Amendments to advertised offers and discounts
YOU are in control and can change your offer or discount at any time - with reasonable notice by contacting us - allowing enough time for outpink.com to update the Partner advertisement and inform our members.
Informing Staff
All Partner`s sites/staff must be informed on the advertised offers or discounts available to outpink.com members so that there is no confusion when an outpink.com member presents their membership card for the advertised offer or discount.
Termination of agreement
At the end of the 12-month period you can opt out of the agreement by notifying us via email, otherwise the agreement will rollover until the following year - An agreement can be terminated at anytime with 30 day`s notice by either party. Upon termination of this Agreement, the Partner shall discontinue use of any materials provided by outpink.com.
License to use the design, artwork, copy, and photographic images provided by the Partner
The Partner agrees to allow outpink.com to use the design, artwork, copy, and photographic images provided by the Partner for promotion of the Partner`s Business/Company through either print or digital media as deemed suitable by outpink.com. Any such advertising or promotional materials must be approved by the Partner prior to publication.
outpink.com communications
Outpink.com maintains regular contact with members by a monthly e-mail newsletter. All communications sent to outpink.com members will be strictly outpink.com-related. If you have an extra special offer/discount or special event planned please contact us so that we can include it in our monthly communication.
Display a FREE outpink.com window sticker [Optional]
Partners will have the option when completing the Partner registration to receive an outpink.com window sticker, showing you are an outpink.com Partner.
Privacy policy
When you sign-up as an outpink.com Partner you will be required to provide outpink.com with complete registration details - Partner Registration. We use this information to communicate with you directly and only publish the information that is stated "IMPORTANT": The following information will be displayed in your online listing. All personal information is held/used by us in accordance with the UK data protection legislation and will NOT be shared with any third parties without prior written consent.
